FRAUD

- Whoever, by deceit, falsehood, or other fraudulent means, whether or not constituting false pretence within the meaning of this Act, deprives the public or any person, whether determined or not, of any property, service, money, or value

- The seriousness of the charge varies according to the amount of the fraud: if the value is above $5,000, the objective seriousness is increased and the consequences are more severe.

THEFT

- Anyone who fraudulently and without appearance of right takes, or diverts to his own use or to the use of another person, fraudulently and without appearance of right, any thing whatsoever, animate or inanimate, with the intention :

a) deprive, temporarily or absolutely, its owner, or any person having a special right of ownership therein or a special interest therein, of that thing or of his right or interest therein;

b) pledge it or deposit it as security;

c) or to relinquish it on a condition, for its return, that the relinquishing party may be unable to fulfill;

d) act in respect of it in such a way that it is impossible to restore it to the condition in which it was at the time it was taken or misappropriated.


- The seriousness of the charge varies according to the amount of the theft: if the value is over $5,000, the objective seriousness is increased and the consequences are more severe.

- This offence includes what is more commonly known as 'shoplifting', which is often a theft under $5,000.

INFLUENCE ON THE PUBLIC MARKET

- Every person who, through the facilities of a stock exchange, curb market or other exchange, with intent to create a false or misleading appearance of active public trading in a security, or with intent to create a false or misleading appearance as to the current price of a security, is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years or is guilty of an offence punishable on summary conviction.

FRAUDULENT MANIPULATION OF STOCK MARKET TRANSACTIONS

- Every one is guilty of an indictable offence and liable to imprisonment for a term not exceeding fourteen years who, by deceit, falsehood or other fraudulent means, whether or not constituting a false pretence within the meaning of this Act, with intent to defraud, affects the public quotation of stocks, shares, merchandise or anything offered for sale to the public.
