CYBERCRIMES :

Cybercrime is a type of crime involving a computer or computer network.

canadian criminal code :

FRAUD

- Whoever, by deceit, falsehood, or other fraudulent means, whether or not constituting false pretence within the meaning of this Act, deprives the public or any person, whether determined or not, of any property, service, money, or value

- The seriousness of the charge varies according to the amount of the fraud: if the value is above $5,000, the objective seriousness is increased and the consequences are more severe.

IDENTITY THEFT

- It is an offence to obtain or have in one's possession identifying information about another person with the intent to use it to commit an indictable offence involving fraud, deceit or falsehood.

CHILD PORNOGRAPHY

- Every one is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years or to an offence punishable on summary conviction who, fraudulently and without colour of right :

a) directly or indirectly, obtains computer services;

b) by means of an electromagnetic, acoustic, mechanical or other device, directly or indirectly, intercepts or causes to be intercepted any function of a computer;

c) directly or indirectly, uses or causes to be used a computer with the intent to commit an offence under paragraph a) or b) or section 430 involving computer data or a computer;

d) has in his possession or uses, or traffics in or permits another person to use, a computer password that would permit the commission of the offences set out in paragraphs a), b) or c);

UNAUTHORIZED USE OF COMPUTER

- Anyone who produces, prints or publishes, or has in his possession for the purpose of publication, child pornography is guilty of an indictable offence and liable to imprisonment for a term not exceeding fourteen years, with a minimum penalty of one year.
